If you caused an auto accident a year, two years, or even close to three years ago and just got served with a lawsuit, it can feel alarming, especially when the paperwork lists a demand of $75,000 or more. In this video, Jobeth explains why this is a situation most people can handle without paying anything else out of pocket.

If you had a valid auto insurance policy at the time of the accident, that policy is still what applies, even if the lawsuit comes years later. As part of your insurance contract, the company is obligated to assign you an attorney and defend the claim on your behalf, using the same claim number that was created when the accident first happened.

Understanding How the Insurance Company Handles the Defense

The attorney assigned to defend you technically represents you, but is paid by and works to protect the insurance company’s financial interests. This is a standard part of how auto insurance functions, and in almost all cases, your goals and the insurance company’s goals in resolving the claim align. Beyond your own time and any related costs like transportation, you should not be paying out of pocket for the attorney, the litigation process, or any experts involved in your defense.
