When you’re injured in an accident and the other driver is charged with a traffic offense, you might receive a court summons. It’s common to assume that criminal or traffic proceedings automatically affect your personal injury claim — but in Maryland, those two legal tracks operate independently. The traffic case addresses whether the driver broke the law, while the injury case is about compensation. Even though both may arise from the same event, their outcomes don’t always align.

Guilt or No Guilt Doesn’t Break Your Case

One of the most common concerns clients express is whether a lack of conviction in traffic court weakens their injury claim. In reality, the outcome of a traffic case rarely determines the success of a civil injury case. For instance, if the other driver receives probation before judgment (PBJ) or has charges dropped, it doesn’t mean your injury case is compromised. Likewise, if the driver isn’t charged at all, your right to pursue compensation remains intact.

When Criminal Charges Might Support Your Claim

While traffic charges and civil claims are distinct, certain guilty pleas can help. A conviction for “failure to maintain speed to avoid a collision” may weigh in your favor when establishing liability. However, irrelevant infractions — like expired tags or missing registration — offer no support, even if the driver pleads guilty. What matters is whether the charge is directly tied to the cause of the crash.

Supporting the State’s Case Doesn’t Hurt Yours

Sometimes prosecutors request documents from you — like medical bills — to support their case against the at-fault driver. These materials can be used to push for penalties or restitution. While restitution may help recover some out-of-pocket costs, it doesn’t replace or reduce your civil settlement. The two are handled separately.
