Who Pays Medical Bills in a Carpool Accident?

If you’re injured as a passenger in a carpool accident, the question of who covers your medical bills isn’t always straightforward. Attorney Bowers breaks down how liability and personal injury protection (PIP) coverage interact, especially when you’re not the driver — or even in your own car.

The At-Fault Driver and Liability Coverage

If the carpool you’re riding in is rear-ended, the at-fault driver’s insurance typically pays for damages through their liability policy. This is the first layer of coverage. But things get more complicated if that driver doesn’t have enough coverage — especially when multiple passengers are injured.

What If You’re Just a Passenger?

Maryland law requires that PIP coverage from the host vehicle cover all eligible passengers — even if they’re not related to the driver. This means you may receive up to $2,500 for medical bills and lost wages. However, if you’ve waived PIP coverage on your own auto policy, you may be disqualified from receiving this benefit.

Why Your Own Insurance Still Matters

Even if your car isn’t involved in the crash, your personal policy might still come into play. If your host’s PIP coverage runs out, you may be eligible for additional “excess” PIP benefits from your own insurance — but only if you didn’t waive them. This is one more reason Attorney Bowers advises clients not to waive PIP coverage.
